Result service processing terms
These terms apply to the result service that Markus Lintuala (the result service provider) provides to the club organising a competition (the organiser). They are also the agreement on the processing of personal data under Article 28 of the EU General Data Protection Regulation.
The result service provider sends a link to these terms in the first e-mail of every order. The organiser accepts the terms when it confirms the result service order in reply to that e-mail. The terms apply for the duration of the competition's result service and for as long as the competition's publications are on the site.
1. Roles
The organiser is the controller of the competition's personal data. The result service provider processes it on the organiser's behalf as a processor. Sub-processors are listed in section 5.
2. Subject matter and purpose of processing
The competition's result service: exporting entry data from Taikkari to the result software, the judges' papers, scoring, publishing the results at fs.lintuala.fi, the compiled protocol and, in synchronized skating, a possible team presentation. The data subjects and categories of data are described in section 3 of the privacy notice.
3. The organiser's standing instructions
- Publication: the result pages, the judges' scores (PDF) and the compiled protocol are published openly on fs.lintuala.fi. For the Minit, Tintit and Tulokkaat categories, in accordance with the Association's rulebook, only the placements and total scores of the top three are published; the other participants are listed in starting order. In other categories, skaters are published under the name recorded in SuomiSport unless the organiser instructs that publication be limited.
- Search engines: the result pages may appear in search engines. PDF files are marked so that search engines do not include them in their results.
- Photos: a podium or team presentation photo is published only once the organiser has verified the photography consent with the skater's club and has the photographer's permission to publish.
- Retention: the publications remain on the site until the organiser asks for their removal or the site is closed. The retention period of the protocol tool's working data is extended only at the organiser's request.
- Removal requests: a data subject's request to remove their name is always carried out without separate approval, as described in section 6 of the privacy notice, and the organiser is informed.
- Additional recipients: results are sent to a live result service or another recipient only at the organiser's separate request. The organiser chooses the recipient and is responsible for its data protection. The recipient is named next to the competition in the competition list.
4. The organiser's responsibilities
The organiser is responsible for the legal basis of the processing, informs skaters and officials in the competition announcement that the results will be published and refers to the privacy notice there, obtains and keeps the photography consents, responds to data subjects' requests with the result service provider's assistance and makes any notifications to the supervisory authority.
5. The result service provider's obligations as processor
- Instructions: data is processed only in accordance with these terms, the privacy notice and the organiser's instructions. If the result service provider considers an instruction to infringe data protection law, the provider tells the organiser.
- Confidentiality: only the result service provider processes the data.
- Security: unpublished material is on the provider's own computer and in the protocol tool. The published site is on a Zerodistance server in Finland. Only the provider has access to the site's administration.
- Sub-processors: Zerodistance (ZD Communications Oy; publishing platform for the site, Finland) and figureskatingtools.com (protocol and judges' papers; Microsoft Azure in the EU and Mailgun's EU region; its privacy notice describes the limited access from the United States by its sub-processors). The organiser is informed of changes before they take effect and may then object to the change. The result software runs on the provider's own computer in Finland.
- Assistance: the provider forwards data subjects' requests to the organiser and carries out removals under section 3. The organiser is notified of a personal data breach without undue delay.
- End of processing: the result software's competition database is destroyed at the end of the competition season, the protocol tool's working data is deleted under that tool's own retention rules and the publications are handled under section 3.
- Information and audits: on request, the provider gives the organiser the information it needs to demonstrate that the processing is appropriate.
6. Closing the site
If the site is closed, the organiser is informed in advance and the publications are handed over to it or deleted on its instruction.
7. Other terms
Fees for the result service are agreed separately; these terms do not cover them. The provider is not liable for indirect damage or for damage caused by an error in the organiser's instructions or in material it has supplied. These terms are governed by Finnish law.
